The customer guarantees that they have the necessary authorizations to use the chosen payment method. Payment is made in euros (EUR). Bank information is transmitted in a secure and encrypted manner.

The payment will be debited from your account upon order confirmation, after verification of data and authorization from your bank.

Article 11 - Delivery

Products purchased are delivered to the delivery address provided by the Customer at the time of the order. Delivery costs are calculated based on the destination, the delivery method selected, and the total order amount.

1. Standard Delivery
The average delivery time is 6 to 7 business days for international delivery, except in cases of force majeure.

2. Express Delivery
Express delivery is available in certain geographical areas. The delivery times are:

  • In mainland France: 2 to 3 business days.

  • In Europe: 3 to 6 business days.

Products will be shipped within 1 to 3 business days after order confirmation.

Article 12 - Right of Withdrawal

In accordance with applicable law, the customer has the right to withdraw from the contract within a period of 14 days from the date of receipt of the goods without having to justify a reason.

The customer must inform the seller of their decision to withdraw by completing and sending the withdrawal form or any other unambiguous declaration. Upon exercising the right of withdrawal, the customer must return the products in their original condition, including packaging, within 14 days of notifying the seller.

Return shipping costs are borne by the customer unless the product is defective or does not match the order.

Article 13 - Warranty

All products sold are covered by the legal warranty of conformity and the warranty against hidden defects, as provided for by the Consumer Code.

In the event of a non-conformity or hidden defect, the customer may request a replacement or repair of the product at no additional cost, provided the product is returned in its original condition.

If repair or replacement is impossible, the customer may request a refund of the product's price.

Article 14 - Product Warranty

14-1 Legal Warranty of Conformity The Seller agrees to deliver a product that conforms to the contractual description and the criteria outlined in Article L217-5 of the Consumer Code.

The Seller is responsible for defects in conformity existing at the time of delivery of the Products, which appear within a period of two years from that time.

This warranty period applies without prejudice to Articles 2224 and following of the Civil Code, with the limitation period starting from the day the Client becomes aware of the defect of conformity.

Defects in conformity that appear within a period of twenty-four months or twelve months for second-hand goods from the delivery of the Products are, unless proven otherwise, presumed to exist at the time of delivery.

In case of a defect of conformity, the Client can demand that the Products be brought into conformity by repair or replacement or, failing that, a reduction in price or cancellation of the sale, under the legal conditions.

The Client may also suspend the payment of all or part of the price or the provision of the benefit specified in the contract until the Seller has fulfilled its obligations under the legal warranty of conformity, under the conditions of Articles 1219 and 1220 of the Civil Code.

It is the Client’s responsibility to request from the Seller the conformity of the Products, by choosing between repair and replacement. The conformity of the product must be achieved within a maximum period of thirty days following the Client’s request.

The repair or replacement of the non-compliant Product includes, if applicable, the removal and return of the product, as well as the installation of the conforming or replaced product.

Any Product made compliant under the legal warranty of conformity benefits from an extension of this warranty for six months.

In case of replacement of the non-compliant Product, when, despite the Client’s choice, the Seller has not completed the conformity, the replacement triggers a new legal warranty period starting from the delivery of the replaced Product.

If the requested conformity is impossible or entails disproportionate costs under the conditions set out in Article L217-12 of the Consumer Code, the Seller may refuse it. If the conditions in Article L217-12 of the Consumer Code are not met, the Client may, after formal notice, enforce the initial solution by legal action, in accordance with Articles 1221 and following of the Civil Code.

The Client may also demand a price reduction or cancellation of the sale (unless the defect of conformity is minor) in the cases provided for in Article L217-14 of the Consumer Code.

When the defect of conformity is so severe that it justifies an immediate reduction in price or cancellation of the sale, the Client is not required to request the repair or replacement of the non-compliant Product in advance.

The price reduction is proportional to the difference between the value of the Product delivered and its value in the absence of the defect of conformity.

In case of cancellation of the sale, the Client will be refunded the price paid upon return of the non-compliant Products to the Seller, at the Seller’s expense.

The refund will be made as soon as the non-compliant Product is received or proof of its return by the Client, and no later than fourteen days after, using the same payment method used by the Client for the purchase, unless the Client expressly agrees otherwise, and in any case, without additional charges.

These provisions are without prejudice to any potential compensation for damages suffered by the Client due to the defect of conformity.

14-2 Legal Warranty Against Hidden Defects Under Articles 1641 and following of the Civil Code, the Seller guarantees the existence of hidden defects that may affect the goods sold. The Buyer must prove that the defects existed at the time of sale and are such that they make the goods unfit for the purpose for which they were intended. This warranty must be exercised within two years of discovering the defect.

The Buyer may choose between the cancellation of the sale or a reduction in price in accordance with Article 1644 of the Civil Code.

Article 15 - Right of Withdrawal

Application of the Right of Withdrawal

The buyer has a period of 30 days from the date of delivery of the order to return any item that does not meet their expectations and request an exchange or refund without penalty, except for the return costs, which remain the responsibility of the buyer.

Returns must be made in their original condition and complete (packaging, accessories, instructions...) allowing them to be resold as new, accompanied by the purchase invoice.

Damaged, soiled, or incomplete products will not be accepted for return.

The right of withdrawal can be exercised online, using the withdrawal form available on this website. In this case, an acknowledgment of receipt on a durable medium will be immediately sent to the buyer. Any other form of declaration of withdrawal is accepted. It must be clear and express the intention to withdraw.

In the case of exercising the right of withdrawal within the above-mentioned period, the client must notify their withdrawal by email to the following address: contact@westaff-bijouterie.com

The price of the product(s) purchased and delivery costs will be refunded.

Return costs are the responsibility of the buyer.

Exchange (subject to availability) or refund will be made within 3 days from the receipt of the returned product(s) by the seller under the conditions specified above.

Exceptions

According to Article L221-28 of the Consumer Code, the right of withdrawal cannot be exercised for contracts:

  • Providing goods whose price depends on fluctuations in the financial market beyond the professional’s control and which may occur during the withdrawal period;

  • Providing goods made according to the consumer's specifications or clearly personalized;

  • Providing goods that are liable to deteriorate or expire rapidly;

  • Providing goods that have been unsealed by the consumer after delivery and cannot be returned for hygiene or health protection reasons;

  • Providing goods that, after being delivered, by their nature, are mixed in an indissociable manner with other items;

  • Providing alcoholic beverages whose delivery is delayed beyond thirty days and whose agreed value depends on fluctuations in the market beyond the professional's control;

  • Providing urgent maintenance or repair work carried out at the consumer's home, explicitly requested by them, within the limit of replacement parts and works strictly necessary to meet the emergency;

  • Providing audio or video recordings or computer software once they have been unsealed by the consumer after delivery;

  • Providing a newspaper, periodical, or magazine, except for subscription contracts for these publications;

  • Providing non-material digital content that has started after the consumer’s prior explicit agreement and their express waiver of the right of withdrawal.

The company is not obligated to reimburse the additional costs if the consumer expressly chose a more expensive delivery method than the standard delivery method offered by the seller.

Article 16 - Force Majeure and Unforeseen Events

Any circumstances beyond the control of the parties preventing the normal execution of their obligations are considered as causes of exemption from the parties' obligations and result in their suspension.

The party invoking the above circumstances must immediately inform the other party of their occurrence and disappearance.

Acts of force majeure include all irresistible, external, unforeseeable, and unavoidable events that cannot be prevented by the parties despite all reasonable efforts. Specifically, acts of force majeure include: transportation or supply chain blockages, earthquakes, fires, storms, floods, lightning, network outages, or difficulties with telecommunications networks outside the client’s control.

The parties will meet to assess the impact of the event and agree on how to continue the contract’s execution. If the force majeure event lasts longer than three months, the present terms may be terminated by the affected party.

If the force majeure event lasts longer than 90 days and prevents the execution of contractual obligations, the party that considers itself affected may unilaterally terminate the contract.

In addition to force majeure events, the hypothesis of unforeseen events takes into account the increase in the price of any raw material or goods necessary for the production, creation, provision, or delivery of a product sold by the seller, making it impossible for the seller to continue offering this product for sale under reasonable conditions. In such cases, the seller cannot be considered responsible for failing to meet contractual obligations, and the client cannot unilaterally terminate the contract without first attempting to find an amicable solution or renegotiating the contract in good faith. In any case, in the case of unforeseen events, the seller cannot be held responsible for the disadvantages, losses, or missed opportunities experienced by the client.

Article 17 - Intellectual Property

The content of the website remains the property of the seller, who is the sole holder of intellectual property rights on this content.

Buyers agree not to make any use of this content; any total or partial reproduction of this content is strictly prohibited and may constitute an act of infringement.

Article 18 - Data Protection and Privacy

The personal data provided by the buyer is necessary for processing the order and issuing invoices.

It may be communicated to the seller’s partners involved in the execution, processing, management, and payment of orders.

The buyer has the right to access, modify, rectify, and oppose the information concerning them. This right can be exercised under the conditions and according to the methods defined on the website https://westaff-bijouterie.com
